AGENDA November 6. 2019 AGENDA INFORMATION MEETINGS Regular Meetings of the City Council are held the second and fourth Wednesday of each month at the hour of 6:00 p.m. (5:00 p.m. if deemed necessary) for Closed Session matters, if required. The public session of the meeting shall commence at 7:00 p.m. or as soon thereafter as possible. While in the City Council Chamber, please turn off all cellular phones and pagers. AGENDA INFORMATION The agenda contains a brief general description of each item to be considered. The agenda and supporting documentation is available for public review at the entryway of the Council Chambers prior to the meeting. On the Friday prior to the meeting, the agenda can be accessed on the City's web site at http://www.westminster-ca.gov. Live video streaming of regular meetings and an archive of agendas and minutes is also available on the City's website. ATTENDANCE AND PARTICIPATION BY THE PUBLIC Except as specifically provided by law for closed sessions, all meetings of the City Council Agency shall be open and public. Agendas for the City Council Agency meetings provide the public an opportunity to directly address the City Council on items of interest to the public that are within the subject matter jurisdiction of the City Council on any agenda items. NO action may be taken on items not listed on the agenda unless authorized by law. Unless otherwise extended by the City Council, the amount of time for each individual speaker shall not exceed five (5) minutes. WEBSITE/TELEVISED MEETING SCHEDULE Regular City Council meetings are broadcast live on Westminster Cable Channel 3 and REBROADCAST on Monday at 5:00 p.m., Wednesday at 7:00 p.m., Friday at 7:00 a.m. and Sunday at 8:30 a.m. The City's website (www.westminster-ca.gov) provides information about viewing live and archived City Council meetings. If you have internet access, you can follow the meeting live with a video stream on your computer. You will also have access to an archive of recent City Council meeting agendas, videos and minutes. PUBLIC USE OF COUNCIL CHAMBER EQUIPMENT All computer presentations must be e-mailed or provided on a portable USB device to the City Clerk at least four (4) hours prior to the meeting. Items to be displayed on the overhead projector must be submitted to the City Clerk for review by staff to verify appropriateness for general audiences by noon on the day of the meeting and prior to the use of the equipment. (Marwan Youssef) • Staff Report • Mayor and City Council Discussion • Open Public Hearing • Speaking in Favor • Speaking in Opposition • Speaking in Rebuttal (only those who spoke in favor can speak in rebuttal) • Close Public Hearing • Mayor and Councif Member Comments • Council Action RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Overrule any objections received at the subject Public Hearing for the abatement of the weeds; and B) Adopt a Resolution entitled, "A Resolution of the Mayor and City Council of the City of Westminster, Determining and Declaring that Certain Weeds are Growing Upon Certain Streets, Sidewalks, Parkways, and Private Property in the City of Westminster, and Rubbish and Refuse Have Been Deposited Upon Sidewalks, Parkways and Private Property in the City, and That the Same are a Public Nuisance; Ordering and Directing the City Manager to Have Said Weeds Destroyed and to Have Rubbish and Refuse Removed as Required By Law." 5. REGULAR BUSINESS 5.1 Notice of Completion for the Work performed by COPP Contracting, Inc. for the Citywide Slurry Seal and Storm Drain Improvements Project - Project No: Citywide Slurry Seal 18-19. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve an increase of $40,065.47 to Purchase Order No. 14216 for additional work; and B) Accept the subject project and authorize the City Clerk to file a Notice of Completion with the County Recorder's Office. Page 5 AGENDA November 6, 2019 5.2 Allocate Excess Fiscal Year 2018-19 Change in Fund Balance per the City's Fund Balance Policy, and Update the Policy as Recommended. (Sherry Johnson) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve the updated Fund Balance Policy; and B) Approve a transfer of $3,000,000 from the General Fund to the Capital Projects Fund from Fiscal Year 2018-19 Net Change in Fund Balance. 5.3 Acceptance of Grant Award from the OTS (Office of Traffic Safety) Selective Traffic Enforcement Program (STEP) in Fiscal Year 2019-20. (Chief Mark Lauderback) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Accept the Grant Award from the Office of Traffic Safety (OTS) Selective Traffic Enforcement Program for Fiscal Year 2019-2020; and B) Amend the Fiscal Year 2019-20 Adopted Budget by designating grant revenues in the amount of $113,000 and increasing budgeted expenditures of the OTS grant account in the amount of $113,000 towards the Police overtime account, training account, equipment and supplies. 5.4 Approval of Memorandum of Understanding (MOU) with Waymakers for Provision of Juvenile Diversion Services. (Chief Mark Lauderback) RECOMMENDATION: Staff recommends that the Mayor and City Council approve the Memorandum of Understanding (MOU) with Waymakers for provision of Juvenile Diversion services and authorize the City Manager or his designee to execute the MOU. 5.5 Consideration of a Resolution Authorizing Application for and Receipt of SB 2 Planning Grant Funds. (Chet Simmons) RECOMMENDATION: Staff recommends that the Mayor and City Council adopt a Resolution entitled, "A Resolution of the Mayor and City Council of the City of Westminster Authorizing Application For, and Receipt of, SB 2 Planning Grants Program Fund." Page 6 AGENDA November 6, 2019 6. LEGISLATIVE ITEMS 6.1 Adoption and Amendments of the 2019 Edition of the California Building Standards Codes. (Chet Simmons) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Adopt a Resolution entitled, "A Resolution of the Mayor and City Council of the City of Westminster, Setting Forth Local Conditions Justifying Amendments to the 2019 California Building Code, 2019 California Residential Code, 2019 Electrical Code, 2019 California Mechanical Code, 2019 Plumbing Code, 2019 Green Building Standards Code, and 2019 California Fire Code Due to Local Climatic, Topographic, and Geologic Conditions"; B) Introduce an Ordinance for first reading entitled, "An Ordinance of the Mayor and City Council of the City of Westminster, Repealing and Replacing Chapters 15.08 (Building Code), 15.10 (Residential Code), 15.12 (Electrical Code), 15.14 (Mechanical Code), 15.16 (Plumbing Code), 15.20 (Green Building Standards Code), and 15.22 (Fire Code) of Title 15 (Buildings and Construction) Adopting the 2019 Editions of the California Codes and Related Model Codes with Appendices and Amendments Thereto," read by title only and waive further reading; and 7. COMMISSION AND COMMITTEE ITEMS 7.1 Appointments to the Homelessness Task Force (Council Member Appointees). (Christine Cordon) RECOMMENDATION: Staff recommends that the Mayor and City Council appoint five members to the Homelessness Task Force. 8.
