AGENDA June 12, 2019 AGENDA INFORMATION MEETINGS Regular Meetings of the City Council are held the second and fourth Wednesday of each month at the hour of 6:00 p.m. (5:00 p.m. if deemed necessary) for Closed Session matters, if required. The public session of the meeting shall commence at 7:00 p.m. or as soon thereafter as possible. While in the City Council Chamber, please turn off all cellular phones and pagers. AGENDA INFORMATION The agenda contains a brief general description of each item to be considered. The agenda and supporting documentation is available for public review at the entryway of the Council Chambers prior to the meeting. On the Friday prior to the meeting, the agenda can be accessed on the City's web site at http://www.westminster-ca.gov. Live video streaming of regular meetings and an archive of agendas and minutes is also available on the City's website. ATTENDANCE AND PARTICIPATION BY THE PUBLIC Except as specifically provided by law for closed sessions, all meetings of the City Council Agency shall be open and public. Agendas for the City Council Agency meetings provide the public an opportunity to directly address the City Council on items of interest to the public that are within the subject matter jurisdiction of the City Council on any agenda items. NO action may be taken on items not listed on the agenda unless authorized by law. Unless otherwise extended by the City Council, the amount of time for each individual speaker shall not exceed five (5) minutes. WEBSITE/TELEVISED MEETING SCHEDULE Regular City Council meetings are broadcast live on Westminster Cable Channel 3 and REBROADCAST on Monday at 5:00 p.m., Wednesday at 7:00 p.m., Friday at 7:00 a.m. and Sunday at 8:30 a.m. The City's website (www.westminster-ca.gov) provides information about viewing live and archived City Council meetings. If you have internet access, you can follow the meeting live with a video stream on your computer. You will also have access to an archive of recent City Council meeting agendas, videos and minutes. PUBLIC USE OF COUNCIL CHAMBER EQUIPMENT All computer presentations must be e-mailed or provided on a portable USB device to the City Clerk at least 48 hours prior to the meeting. ADMINISTRATIVE ACTIONS 3.2 Final Seven -Year Capital Improvement Program (CIP), MPAH Mobility Element Consistency, and Mitigation Fee Programs for Measure M2 Eligibility Compliance for Fiscal Year 2019-20. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve the Final Measure M2 Seven -Year Capital Improvement Program (CIP) for Fiscal Year 2019-2020 through 2025-26, and authorize its submittal to the Orange County Transportation Authority (OCTA) along with other required documents for M2 Eligibility compliance; and Page 4 AGENDA June 12, 2019 B) Adopt a Resolution entitled, "A Resolution of the Mayor and City Council of the City of Westminster Concerning the Status and Update of the Mobility Element, and Mitigation Fee Program for Measure M (M2) Program." REPORTS 3.4 Confirmation of Approved Administrative Fee Waiver for a Community Workshop held by the Orange County Registrar of Voters. (Diana Dobbert) RECOMMENDATION: Receive and file. 3.5 2019 Report on Water Quality Relative to Public Health Goals. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council accept the 2019 Report on Water Quality Relative to Public Health Goals and receive and file the report. END OF CONSENT CALENDAR 4. PUBLIC HEARINGS — None. 5. REGULAR BUSINESS 5.1 Update on Community Preservation Unit. (Chet Simmons) RECOMMENDATION: Staff recommends that the Mayor and City Council receive and file the report. 5.2 Banner Hanging Request from Garden Grove Unified School District. (Diana Dobbert) RECOMMENDATION: Staff recommends that the Mayor and City Council consider and provide direction regarding written request from Garden Grove Unified School District to hang banners along Brookhurst Street and Bushard Street from August through December 2019. Page 5 AGENDA June 12, 2019 5.3 Award of Contract for the Citywide Slurry Seal and Storm Drain Improvements Project - Project No. Citywide Slurry Seal 18-19. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve the award of contract to the lowest and responsive bidder in the amount of $658,005.00 to COPP Contracting, Inc., and that all other bids be rejected; and B) Authorize a 10% contingency in the amount of $65,800.50 for potential change orders; and C) Authorize the City Manager to execute the contract on behalf of the City. 5.4 Award of Contract for Bolsa Avenue Street Improvements from Brookhurst Street to Ward Street. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve the award of contract to the lowest and responsive bidder in the amount of $1,123,923 to All American Asphalt, and that all other bids be rejected; and B) Authorize a 10% contingency in the amount of $112,392.30 for potential change orders; and C) Authorize the City Manager to execute the contract on behalf of the City. 5.5 Request to Increase Contract with Vertech Industrial Systems for the Design/Build Water Supervisory Control and Data Acquisition (SCADA) System Upgrade by $10,473.54 for Final Miscellaneous Items Necessary to Close Out the Project. (Marwan Youssef) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve a budget increase of $10,473.54 from Water Undesignated Fund to Account Number 55502-155500; and B) Increase the contract for the Design/Build Water Supervisory Control and Data Acquisition (SCADA) System Upgrade with Vertech Industrial Systems in the amount of $10,473.54 to add features necessary to close out the project. LEGISLATIVE ITEMS 6.1 Cooperative Agreement for the Administration of the Orange County Taxi Administration Program and Ordinance Amending Chapter 5.60 of the Westminster Municipal Code Relating to the Regulation of Taxicabs. (Acting Chief Mark Lauderback) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Approve and authorize the City Manager to execute Cooperative Agreement No. C-8-2015 with the Orange County Transportation Authority and Orange County cities for the administration of the Orange County Taxi Administration Program; and B) Introduce an Ordinance for first reading entitled, "An Ordinance of the Mayor and City Council of the City of Westminster, Amending Chapter 5.60 (Taxicabs) of Article II (Business Regulations) of Title 5 (Business Taxes, Licenses and Regulations) of the Westminster Municipal Code," read by title only and waive further reading. 7. COMMISSION AND COMMITTEE ITEMS 7.1 Appointment to the Traffic Commission (Council Member Contreras' appointee). (Christine Cordon) RECOMMENDATION: Staff recommends that the .Mayor and City Council appoint one (1) member (Council Member Contreras' appointee) to serve on the Traffic Commission for the remainder of an existing term expiring in November 2020. 7.2 Appointments to the Youth Committee. (Christine Cordon) RECOMMENDATION: Staff recommends that the Mayor and City Council: A) Appoint seven current Youth Committee members to serve as regular members for a term to expire June 30, 2020; and B) Direct staff to participate in an interview process of the 24 applications to appoint four regular members and two alternate members. 7.3 Update from the Residential and Commercial Development Process Review Subcommittee. (Vice Mayor Kimberly Ho and Mayor Tri Ta) RECOMMENDATION: Staff recommends that the Mayor and City Council receive and file the report. Page 7 AGENDA June 12, 2019 8. BUSINESS MATTERS FROM CITY COUNCIL/AGENCY MEMBERS 8.1 Code of Conduct for Elected and Appointed Officials. (Council Member Tai Do) RECOMMENDATION: Staff recommends that the Mayor and City Council consider and provide direction regarding a Code of Conduct for Elected and Appointed Officials. 8.2 Request to Modify Vote on Previous Appointments to Planning and Community Services and Recreation Commissions. (Council Member Tai Do) RECOMMENDATION: Staff recommends that the Mayor and City Council consider and provide direction regarding Council Member Do's request to modify his vote regarding Commission and Committee Appointments at the January 29, 2019 meeting. 8.3 Council Policy Regarding Placement of Items on the City Council Agenda. (Vice Mayor Kimberly Ho and Mayor Tri Ta) RECOMMENDATION: Staff recommends that the Mayor and City Council consider and provide direction regarding Vice Mayor Ho and Mayor Ta's proposal to adopt a Council Policy regarding the rules and procedure for council members placing items on the City Council agenda. 9. COUNCIL ADJOURNMENT Regular Meeting of Wednesday, June 26, 2019 has been cancelled per Council action on May 22, 2019.
